Rental Agreement

1. Reservations – The attached confirmation contains the agreed upon dates and total fees for this reservation. Reservations are encouraged and will be accepted up to one year in advance at our discretion. When you book your reservation the exact unit you rented will be assigned and blocked for your dates. No unit is completely guaranteed indefinitely as HR Rentals & Property Management does reserve the right to change unit assignments under extreme or otherwise warranted circumstances, such as, but not limited to, previous hurricane or other weather and water damage as to make the unit uninhabitable or an owner of a property cancelling their unit’s participation in the rental program. These are extremely rare, but must be considered and we will do our best to provide a similar unit or give you a refund without penalty if the unit you rented becomes unavailable.

2. Keys/Wristbands/Key Cards/Beach Passes – Items such as wristbands or key cards required at some properties for restricted entry will be treated as keys and must be returned at check-out. If any of the abovenamed items are lost or not returned, a fee of $25.00-$200.00 per missing item will apply depending on unit and type of item lost.

3. Advance Rental Payment – A partial or full payment of the total reservation is required to secure your reservation dates and must be received immediately if you are booking online. If you have booked online and we do not receive payment within 24 hours, your reservation may be canceled.

4. Rates – Rates are based on location, features and seasons, and are subject to change without notice. The rates you agree to at the time of booking, including any specials, are the fees you will be charged. If rates go up or down in the future your reservation will not be changed. Future specials cannot be applied to your agreed upon rental once you secure a unit and it is blocked from being rented by other people at agreed upon terms. Cleaning fees which vary by property and tourist/sales tax will be added to all reservations. You may add nights (subject to availability) and insurance products to your reservation after you book based on prevailing costs and availability at the time you choose to add those items.

5. Rental Payment – The rental payment is due in full 60 days for all reservations. Reservations made less than 45/60 days before arrival must be paid in full immediately to be secured and are not refundable. Bank money order, check, or Visa/Master Card/Discover will be accepted as payment. Your final payment will be charged automatically 60 days before your reservation date. If your final payment is not received and more than 5 days late, we reserve the right to cancel your reservation without a refund. If you decide to charge another card other than the CARD ON FILE for your final balance, you must notify us via email or phone before the final balance is due.

6. HOA APPROVAL – If property is subject to an HOA or Condo Association, occupancy is contingent upon HOA approval of all occupants.

7. Cancellation of Reservation – If you cancel your reservation of 27- nights or less is outside of 30-days of arrival you will receive a full refund. Should you cancel your reservation less than 30 days prior to your arrival, you will lose the total amount paid.** If your reservation is 28-nights or longer – and you cancel your reservation outside of 90 days of arrival you will receive a refund minus $100.00 administrative fee. Cancellations between 60 and 89 days of arrival will forfeit the advanced payment paid at the time of reservation. Should you cancel your reservation less than 59 days prior to your arrival, you will lose the total amount paid. No Exceptions. Once you have booked your dates, they will be locked in. We cannot accommodate date changes or reduce your length of stay. All cancellations must be made in writing stating that you understand you will be forfeiting your payment. Refunds for cancellations, changes or shortened stays due to actual or anticipated hurricanes, tropical storms or other inclement weather will not be issued under any circumstances. Refunds for natural disaster damage that make the property un-occupiable will not be issued under any circumstances. Refunds for events that may render the unit, area and/or amenities unavailable (to include but not limited to; natural or man-made disaster, owner usage, technical glitch, maintenance, pandemic, endemic, travel bans, health concerns, state of emergencies, ordered evacuations, local venue closure, community amenity closure, beach closure and/or the property remaining as a HR Rentals vacation rental at the time of the Tenant stay) will not be issued under any circumstances.

WE HIGHLY RECOMMEND YOU PURCHASE TRAVEL INSURANCE TO COVER ANY UNFORESEEN DIFFICULTIES OR EVENTS. However, even with purchased insurance, HR Rentals & Property Management will not offer any refunds. If insurance is purchased, all claims must be filed with the respective insurance company and all reimbursement is subject to said company and the policy purchased.

8. Right to Change Rental Accommodation – We reserve the right to substitute comparable accommodations without prior notice or liability in the event of a sale of the rental property, or if the property becomes unavailable due to maintenance or other problems. We cannot guarantee a specific rental property in the event of unforeseen circumstances, like a hurricane, which could render the property to be unsafe or uninhabitable. We will make every effort to contact you should this happen. If a unit is not available due to any reason including hurricane damage, the tenant agrees to be moved to any other unit in our inventory based on sleeping capacity alone, NOT AMENITIES. When comparable accommodations are not available, Tenant will have the option of selecting from available properties at the comparable published rate. If the Tenant does not agree to the new location cancellation without penalty will be offered. Again, we strongly recommend you secure trip insurance. This can be purchased from a third party of your choosing. If trip insurance is secured, refunds will be made according to the purchased insurance policy, by the policyholder.

9. Check In/Check Out – Check-In is 4:00 P.M. EST or later. Due to our high standard of cleanliness, there is a possibility that your vacation rental may not be ready at 4:00 P.M. especially during peak seasons. Please do not enter the unit prior to the 4pm check in time unless approved by HR Rentals & Property Management. Failure to do so may result in a fee of $100 per hour (unless early check in is prearranged and purchased, when possible). Check-Out time is promptly by 11:00 A.M. To avoid an extra cleaning charge; please wash the dishes, take out the trash, and leave the property in a neat and orderly condition.

10. Late Night Arrivals – Please be considerate of your neighbors if making a late night arrival. Please ensure you have all necessary directions, door codes, parking passes, and/or security gate combinations. If you have trouble with the codes, call 727-800-6630 and leave message for on-call manager.

11. Cleaning – All of our properties are professionally cleaned before and after each Tenant’s stay. Upon arrival, if you find a cleaning failure please report it HR Rentals & Property Management within one hour of check in so that we can remedy any matters, we will send our cleaning crew as quickly as possible. However; no refunds will be made after we send our cleaning crew. HR Rentals & Property Management will make every effort to satisfy the requirements of each Tenant. If we have not heard from you within four hours of check-in, we will assume that you are satisfied with the cleanliness of the home.

Housekeeping – You will be responsible for the cleaning of your unit during your stay and leaving the property in good condition at checkout. A separate housekeeping/cleaning charge will be included when you book. This is a one-time linen/towel set up and cleaning service ONLY at the time of departure. We request that you remember you are staying in someone’s home during your vacation; please treat it with the care as you would your own. If the unit is left unusually messy (extra unusual cleaning, unwashed dishes, food or garbage left in unit) or left damaged (damages/stains on carpet or furniture or to walls and floors), we reserve the right to apply credit card charges as part of our damage deposit policy for these expenses.

Additional Housekeeping– HR Rentals & Property Management takes great pride in the maintenance of our homes. If any garbage is found on the lawn or around the exterior of one of our homes (this includes cigarette butts and bottle caps), the tenant will be held responsible for additional charges to cover the cost of hiring a maintenance crew for cleanup. This will also apply to balconies or the exteriors of condominiums.

12. Linens/Towels/Supplies – Units are fully equipped. Although linens are provided, please bring your own beach towels, beach blankets and your own personal toiletries. An initial setup of trash liners, bathroom paper and facial soap is provided upon arrival. Extra supplies needed (including cleaning supplies) are the responsibility of the tenant. Upon departure, please place all soiled linens in a pile on the floor house cleaning, place all dirty dishes in dishwasher and run machine. If you leave unit in unusually messy condition, you will be charged an extra cleaning fee outside the normal prepaid cleaning. Moving any items or furnishings from one unit to another is not permitted.

13. Smoking & Pets – ALL units are NON-SMOKING units. Tenants found in violation of this agreement will be asked to leave and full stay rent charge will be due including deposit amount without refund. You hereby understand and agree that if smoking is detected in the Premises, you will be charged for an additional deep cleaning to be done by a professional company, to include steaming and deodorizing the entire Premises to remove smoke odor.

No animals are permitted unless you receive written permission from HR Rentals & Property Management. If permission is granted to bring a pet there will be an additional deposit in addition to a walk through prior to departure. Please make sure to clean up and dispose of any pet waste. Any damages from an approved pet will be charges to the tenant’s Security Deposit or credit card on file. In the event that a pet is found on the Premises without the prior notification and consent of HR Rentals & Property Management, you shall be in violation of this Agreement and this Agreement will be subject to termination with out refund. Pets in the unit will also result in a MINIMUM fine of $250.

14. BBQ Grills – Most of our vacation rentals have either a propane or charcoal grill. We do not provide propane. We will ensure there is a propane tank at the property which you can fill up at most gas stations in the area.

15. Family Rental Only – No units will be rented to anyone under the age of 25 unaccompanied by a responsible parent or guardian in the unit for the entire stay. Any reservation made under false pretense may be subject to forfeiture of advance rental payment/rental payments or security deposit. If more than the authorized number of guests or any unauthorized guests are found on the Premises, this Agreement will be subject to Termination.

16. Good Neighbor Policy – Many of our rentals are located in multi-unit buildings that include short and long term tenants and year round residents. No parties or special events including weddings or large gatherings exceeding the contracted number of people are permitted without prior approval. All tenants/guests and owners are subject to conform to the rules and regulations of the properties. Tenant(s) causing excessive noise or disturbances will be asked to check out immediately and full stay rent charge will be due including deposit amount with NO REFUNDS.

Tenant will comply with all statutes, and ordinances of all authorities. There is a 10:00pm noise ordinance enforced by the city and must be complied with. If Tenant or their party violates and of the house rules or ordinances HR Rentals & Property Management will promptly notify Tenant of the violation and give Tenant a reasonable period within to cure violation. If Tenant fails to cure violation, Tenant is subject to eviction from the property at HR Rentals & Property Management’s discretion.

17. Unexpected Breakdowns – HR Rentals & Property Management cannot guarantee against mechanical failure of heating, air conditioning, televisions, or any other appliances. We do make every effort to keep everything in the best possible working order, which serves both the best interest of the Owner as well as the Tenant. In the event of an unexpected breakdown, we require the Tenant to report all needed repairs or damage to the property manager immediately, and we will resolve the matter as quickly as possible. HR Rentals & Property Management will arrange all repairs. In the event that it is necessary to make repairs to the Premises, HR Rentals & Property Management and the Owner reserve the right to enter the Premises for repairs and inspections. No refunds or rent reductions will be made due to failure of appliances or equipment. No refunds for reducing the number of nights reserved or early departures. Any refund requests will need to be sent in within in writing, responses will take up to 10 business days.

18. Entry and Inspection – Tenant agrees that HR Rentals & Property Management may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Agent may deem appropriate, or to show Premises to prospective purchasers or tenants. We reserve the right to enter the Premises at any time for a property walkthrough. The tenant will be given a notice before we enter the premises. No notice will be given in case of an emergency.

17. In Case of Emergency – Please call 727-800-6630. Your call will be returned as soon as possible. PLEASE NOTE: In the event you are locked out of your unit after business hours, follow emergency procedures after calling number listed above. An agent will return your call and meet you at the unit. A charge of $50.00 will apply and must be paid at the time of the event in cash or check.

18. Parking – Parking will only be for one vehicle unless otherwise stated. If you are bringing a boat/watercraft or RV, you must verify that there is appropriate parking on site before arriving. Please do NOT bring a trailer unless our management allows you to do so, many of the properties cannot accommodate them. You will be subject to all parking rules, regulations and fines that are in place at the location you are renting.

19. A/C System – The A/C systems are not to be set below 72° with the Florida humidity setting the system below 72° can cause it to freeze up and damage the system.

20. Damages – We require a valid credit card to be on file to cover any losses or damages that may occur during your stay. Your credit card may be charged without your prior notification if we find damages that weren’t present when you arrived and you didn’t report before you departed, although we will make every effort to contact you prior to charging your card. If extra cleaning or repairs are required as a result of your stay, we reserve the right to apply the full amount of those costs to your credit card, plus all applicable taxes and fees and any costs as quoted and attested to by a certified contractor in addition to the total rental amount plus taxes/fees that you originally paid to offset the additional incurred expenses as a result of your stay.

All reservations must have a valid credit or debit card placed on file. If you are paying your final balance by check, a card must be placed on file for your booking or you will not receive your check in instructions.

CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, that an email of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the rental is vacated. Additional charges may include: unauthorized long distance telephone and satellite TV charges; excessive cleaning fees; damages beyond normal wear and tear and unreturned keys. If the listed card is declined, expired, or otherwise I agree to allow HR Rentals & Property Management to charge a card that was used to make any rental payment for my reservation. When your final payment is due, 60 days before your reservation, your credit card will be charged automatically for the balance due.

21. Access Information – House code will be provided by the property manager the day of check-in.

NOTICES HR Rentals & Property Management is the Landlord’s agent. All notices to Landlord and all lease payments must be sent to HR Rentals & Property Management.

HURRICANE POLICY At the discretion of HR Rentals & Property Management all, or a portion, of amounts paid by Tenant, may be refunded if the Tenant must vacate the Premises because the area where the Premises is located has fallen under a Hurricane Warning as issued by the National Hurricane Center. Tenant agrees to comply with any evacuation orders issued for the area, and will make reasonable efforts to secure the Premises prior to departure. The Tenant is hereby advised and understands that the personal property of the Tenant is not insured by the Landlord for either damage or loss from any cause, including a natural disaster such as a hurricane, tropical storm, flood or fire, and the Landlord assumes no liability for any such loss. The Tenant is also advised and understands that, in the event there is an occurrence which causes damages to the premises including, but not limited to a hurricane, tropical storm, flood or fire, and the property is rendered temporarily uninhabitable as a result thereof, the Landlord has no obligation to pay for the Tenant’s temporary substitute housing or other living expenses while the property is being repaired. The Tenant is, accordingly, hereby advised and understands that he or she should obtain a renter’s insurance policy, for the period of the tenancy, which provides coverage for Tenant’s personal property and which will pay for Tenant’s temporary substitute housing for the period that the property is unavailable for occupancy due to any cause, including a natural disaster such as a hurricane, tropical storm, flood or fire.

ATTORNEYS` FEES In the event that either party hereto is required to institute litigation or some other form of alternative dispute resolution to enforce the terms of this Agreement, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable costs and attorney`s fees.

APPLICABLE LAW AND VENUE This Agreement shall be construed and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. The parties hereto consent to the exclusive jurisdiction of the courts of either Pinellas County, Florida or the Middle District of Florida for any disputes relating to this Agreement. Tenant(s) acknowledge(s) that he/ she/they has/have read and agree to all terms and conditions.

DEFAULT; WAIVER Should Tenant fail to fulfill the obligations under this Agreement, or violate any other term or condition of this Agreement, HR Rentals & Property Management shall then have the right to immediately re-enter the Premises and terminate this Agreement. HR Rentals & Property Management shall have all rights and remedies provided by law for Tenant’s breach of, or noncompliance with, any of the covenants or agreements herein contained, all of which rights and remedies of HR Rentals & Property Management shall be deemed cumulative and not mutually exclusive, to the fullest extent permitted by law. It is mutually agreed between HR Rentals & Property Management and Tenant that HR Rentals & Property Management s’ failure to take advantage of any default on the part of Tenant shall not be construed as a waiver thereof, nor shall any custom or practice that may develop between the parties during the Agreement term be construed to waive or to lessen the right of HR Rentals & Property Management to insist on strict and timely performance by Tenant of the provisions hereof. Each and every covenant and agreement hereof is of material importance to HR Rentals & Property Management. Failure by us to enforce any provision of this Agreement will not be deemed a waiver of that or any other provision.

NON-LIABILITY Neither HR Rentals & Property Management or Owner shall be responsible for any injury or damage to Tenant or the personal property brought onto the Premises by Tenant, which shall at all times be at the sole risk of Tenant, unless such injury or damage is the direct result of HR Rentals & Property Managements’ or Owner’s gross negligence. NEITHER HR RENTALS & PROPERTY MANAGEMENT NOR OWNER SHALL BE LIABLE TO TENANT FOR ANY DAMAGE OR INJURY TO TENANT, OR TENANT’S FAMILY, INVITEES, OR PROPERTY, ARISING OR GROWING OUT OF ANYTHING OTHER THAN GROSS NEGLIGENCE OF HR RENTALS & PROPERTY MANAGEMENT OR OWNER, AS THE CASE MAY BE, AND TENANT AGREES THAT IT IS OCCUPYING THE PREMISES AT TENANT’S SOLE RISK. Tenant agrees to hold HR Rentals & Property Management and Owner harmless from any claims for damages, no matter how caused. Tenant shall indemnify and hold harmless HR Rentals & Property Management and Owner, and their respective members, managers, officers, employees and agents, from and against any and all claims, lawsuits, investigations, penalties, liabilities, losses, costs, expenses (including reasonable attorney’s fees and expenses), and damages suffered or incurred by any of them arising out of or related to any act or omission by Tenant, except to the extent caused or contributed to (in whole or in part) by the gross negligence or intentional conduct of HR Rentals & Property Management and/or Owner.

RENTAL ASSIGNMENT CHANGE HR Rentals & Property Management reserves the right to change Rental Assignments without prior notice or liability in the event of a sale of the rental property, or if the unit becomes unavailable. When comparable accommodations are not available, Tenant will have the option of selecting from available properties or receiving a refund on the monies paid to HR Rentals & Property Management.

CONSTRUCTION HR Rentals & Property Management or owner cannot be responsible for the failing of any other company due to said company’s error or service interruption {i.e. electricity, water, gas, cable, Internet provider, etc.} and acts of neighbors such as: construction, road repair and maintenance or act of god (weather). However, Owners and HR Rentals & Property Management agree to do all that is reasonably possible to remedy any issue as quickly as possible. No refunds or adjustment of rental fees will be made for any of the above conditions.

REPRESENTATIONS Neither party has made any representations or promises, except as contained herein, or in some further writing signed by the party making such representation or promise.

RADON GAS The following disclosure is required by Florida law: “RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public health unit.”

PHOTOGRAPHY: Tenant is not allowed to use the home for photos or images for commercial use unless written permission is provided.

MODIFICATIONS This Agreement may not be changed, altered or modified orally or in any other manner other than by a written agreement signed by all the parties hereto.

SYNTAX Whenever used herein, the singular form shall include the plural, the plural form shall include the singular, and any gender or neuter form used shall include the other gender or the neuter form, as applicable. In the event the term Tenant or Guest is defined as more than one person, each such person is and shall be jointly and severally liable for the performance of each and every provision of this Agreement.

SEVERABILITY If any provision of this Agreement is determined to be invalid by any court of competent jurisdiction, the remaining portions shall nevertheless remain in full force and effect.

BINDING EFFECT All covenants and representations shall be binding upon and shall inure to the benefit of the heirs, executors, administrators and assigns of HR Rentals & Property Management and Tenant.

TIME Time is of the essence in this Agreement.

OWNER’S AUTHORIZED AGENT: HR Rentals & Property Management is acting as the authorized agent of Owner. In the event HR Rentals & Property Management ceases acting as the authorized agent of Owner, all rights granted hereunder to HR Rentals & Property Management shall be deemed to extend to Owner. HR Rentals & Property Management shall have the right to terminate this lease upon Tenants failure to comply with the provisions contained in this agreement.

HOUSE RULES:

1. There is a noise ordinance in effect after 10 pm and before 7 am. Please be a good neighbor and keep noise down at all times. If the neighbors call the police to the house due to a violation of this ordinance, YOU WILL BE ASKED TO LEAVE IMMEDIATELY WITHOUT A REFUND.

2. You will be held responsible for damages due to a violation of any rules or irresponsible misuse of the premises.

3. Please report any damaged or nonfunctioning items in the property immediately.

4. No special events are allowed on the premises.

5. If you have any questions or need any help in regards to any of the appliances, electronics, or devices in the unit, you are required to contact HR Rentals & Property Management directly. UNDER NO CIRCUMSTANCES should you contact any neighbors, friends, family members, or anyone who is not a representative of HR Rentals & Property Management for maintenance and repair request, technical support and/or trouble shooting any appliances, electronics, TV(s), streaming applications and services, cable box(s), or internet issues as you may receive misinformation or this may result in damage to these items. Obtaining technical support or trouble shooting assistance for any items or services in the unit from anyone other than a HR Rentals & Property Management representative is a violation of this Rental Agreement.

Tenant acknowledges – THIS RENTAL AGREEMENT IN FULL AND ACCEPTS ALL TERMS BY TENANT/GUEST SIGNATURE BELOW UPON RECEIPT OF THIS AGREEMENT AS OF RESERVATION OR

Tenant also acknowledges that HR Rentals & Property Management is the agent of the property owner and will be paid by the owner. The use of the owner’s WiFi is provided as a convenience to guests. Under no circumstances, however, if a tenant/guest uses the WiFi to engage in any act that violates the Copyright Act of 1976 (including but not limited to using file sharing sites to share or download copyrighted content) or to access any content or engage in any act that violated any applicable law.
